1. ACCEPTANCE; BINDING AGREEMENT

Accessing any page, asset, API endpoint, game, wallet prompt, or feature of the Platform constitutes acceptance of this entire document (collectively, the “Terms”), including all risk disclosures, as a legally binding agreement to the maximum extent permitted by applicable law.

If you use the Platform on behalf of an entity, you represent that you have authority to bind that entity, and “you” includes the entity.

Electronic acceptance, wallet signature, continued use, or clicking through any interface is sufficient to form a contract under applicable electronic transactions laws (including, where relevant, the U.S. E-SIGN Act and UETA).

2. ELIGIBILITY; AGE; RESTRICTED PERSONS

• You must be at least eighteen (18) years of age (or the age of majority in your jurisdiction, if higher).
• You must have full legal capacity to enter contracts.
• You are solely responsible for determining whether your use is lawful where you live, work, travel, or are taxed.
• You represent that you are not a person or entity on any sanctions, denied-party, or restricted list administered by OFAC, the UN, EU, UK, or other applicable authority; not located in a comprehensively sanctioned jurisdiction; and not using the Platform to evade law.
• The Platform is not directed to children. We do not knowingly collect data from minors.

We may refuse, suspend, or geo-restrict access at any time without notice where we believe use is unlawful, abusive, or high-risk.

Optional Awardz Pool entry (Section 11A) is further limited: it is void where prohibited. You must not enter if paid player-versus-player skill contests, prize competitions with consideration, or any similar activity is unlawful where you live, work, travel, or are present, or if it would require a gambling, lottery, or contest license we do not hold. Entering Awardz is a representation that you are 18+ (or majority, if higher) and that your participation is lawful for you.

3. NATURE OF THE PLATFORM (WHAT WE ARE / ARE NOT)

Without limiting the foregoing, DOSWAPZ is NOT (and does not operate as):

• a bank, broker-dealer, exchange, ATS, payment institution, or e-money issuer. A published-address Awardz entry (Section 11A) and a one-sale E.K. crypto hold (Section 15B) are described in those sections. Neither is a bank, neither is general money transmission, and neither is custody of your seed or of your other funds;
• an investment adviser, commodity trading advisor, fund manager, or fiduciary;
• a clearinghouse, prime broker, or market maker for your account;
• a casino house, bookmaker, sportsbook, or opponent in player-versus-player arcade contests (optional Awardz Pool, if enabled, is PVP among users — see Section 11A);
• a law firm, accounting firm, tax preparer, or professional advisory practice;
• an insurer or guarantor of any outcome, token price, mint, swap, game score, contest result, or user content;
• a party to peer-to-peer trades executed on-chain between you and unrelated counterparties or automated market makers, except to the extent a pure interface merely displays or routes requests you authorize;
• the seller, the buyer, the merchant of record, or the shipper of an E.K. sale between users (Section 15B). The DOSWAPZ fee on that shop is zero. PayPal on E.K. is paid to the seller. Crypto on E.K. is a limited hold of that one sale’s principal in a published operator wallet until the written release or refund. That hold is not a bank, not general money transmission, and not custody of the user’s seed or of any other funds.

Any branding, CRT aesthetics, “nodes,” “ponds,” “basements,” “time machines,” or narrative framing is creative presentation, not a representation of regulated financial infrastructure.

Optional account login (Section 6A) is an off-chain site record. It is not a deposit account and not custody of funds. Optional E.K. (Section 15B) is a shop between users. PayPal on that shop is paid to the seller and is not custody. A crypto sale can place that sale’s principal in a published operator wallet until release or refund. That wallet hold is not a deposit account and not custody of any other funds.

4. NO ADVICE; NO RECOMMENDATIONS

Nothing on the Platform is an offer, solicitation, recommendation, endorsement, or advice to buy, sell, hold, mint, stake, launch, or interact with any digital asset, protocol, NFT, game outcome, or strategy.

• Content may be incomplete, outdated, satirical, generative, gamified, or fictionalized.
• Token symbols, tickers, “markets,” scoreboards, dossiers, and AI chat are not research reports.
• Past performance (of tokens, games, simulations, or narratives) is not indicative of future results.
• You must conduct your own independent due diligence (“DYOR”) and rely solely on your own judgment and professional advisers.

5. EXTREME RISK DISCLOSURE - DIGITAL ASSETS

Digital assets are highly speculative and volatile. You can lose some or all of any value you put at risk - including entire wallet balances - suddenly and permanently.

Risks include, without limitation:

• Market risk: extreme price swings, illiquidity, gaps, cascades, and total loss of market value.
• Smart contract / protocol risk: bugs, exploits, economic attacks, oracle failures, upgrade keys, admin keys, pause functions, and irreversible code execution.
• Blockchain risk: congestion, reorgs, finality failures, network partitions, consensus bugs, fee spikes, and chain halts.
• Wallet / key risk: phishing, malware, seed phrase theft, approval drains, malicious dApps, clipboard attacks, and irreversible transfers.
• Counterparty / issuer risk: rugs, abandoned projects, insider dumps, misleading metadata, impersonation tokens.
• Regulatory risk: sudden legal changes, enforcement actions, delistings, or restricted access in your region.
• Tax risk: taxable events may occur on swaps, mints, airdrops, or other interactions whether or not you “cash out.”
• Operational risk: RPC outages, indexer lag, CDN failures, browser bugs, and UI display errors.
• Information risk: wrong prices, wrong balances, delayed stats, spoofed tokens with similar names.

Never connect a wallet, approve a token, sign a transaction, or risk funds you cannot afford to lose entirely. Practice proper OPSEC. Prefer a dedicated burner wallet with minimal balances for experimental dApps.

6. WALLETS, KEYS, SELF-CUSTODY

• You remain solely responsible for your wallets, seed phrases, private keys, hardware devices, passkeys, and device security.
• Except as expressly described in Section 11A (optional Awardz Pool contest entries sent to published operator addresses) and in Section 15B (the principal of one E.K. crypto sale, held in a published operator wallet until the written release or refund), we do not custody user funds, cannot reverse on-chain transactions, and cannot recover lost keys. The E.K. hold is not a bank account, not general money transmission, not custody of a seed, and not custody of any other funds. The DOSWAPZ fee on that principal is zero. PayPal on E.K. is paid to the seller and is not held by DOSWAPZ.
• Connecting a wallet to swap, mint, or sign a transaction does not by itself create a deposit, bailment, or custodial account. Optional Account Login (Section 6A) can create an off-chain site account tied to an email or to a public wallet address. That account is not a bank account, not custody of funds, and not insurance. An Awardz entry, if you opt in, is contest consideration you may lose entirely; it is not a bank deposit, not an insured account, and not safekeeping of your remaining bag.
• You are responsible for reviewing every signature request, transaction simulation (if any), spender approval, and destination address before confirming.
• Unlimited or high token approvals are dangerous; revoke unused approvals using trusted tools when appropriate. Awardz, if live, is native SOL or ETH value transfer only — no token spend approval.
• DOSWAPZ never asks for a seed phrase. Any seed prompt is a scam. Prefer a dedicated burner wallet. Injected wallets should auto-disconnect after a confirmed Awardz or mint transaction; do not leave a hot wallet connected to the Site.

6A. ACCOUNT LOGIN — WALLET OR EMAIL

Account login is optional. You may use the Platform without an account. If you create one, you choose one door: a public wallet signature, or an email and password. A wallet account and an email account are separate. They are not linked unless a later notice says so.

• You must be at least eighteen (18) years of age (or the age of majority where you live, if higher) and you must accept these Terms. The server rejects login and registration without that attestation.
• An email is an account name. We store it in lowercase. We store the password only as a slow hash with a salt. We do not store the password itself. We do not email you, and we do not offer an email reset, unless a later notice says outbound mail is armed.
• A wallet login uses your public chain address on Solana or Ethereum. The signature is a login proof only. It does not send tokens, approve a spender, execute a swap, or grant DOSWAPZ custody of any asset. We never ask for a seed phrase or private key. Any prompt that asks for a seed is a scam.
• The session is an HttpOnly cookie named dz_acct. It carries an account id, the login method, and an expiry. It does not carry your email, password, seed, or private key. Signing out clears that cookie in your browser. It does not delete the off-chain record.
• This account is not a bank account, brokerage account, exchange account, custodial wallet, deposit, bailment, or insured balance. No FDIC, SIPC, or similar insurance applies. DOSWAPZ is not your broker, adviser, exchange, or fiduciary because you logged in.
• We may suspend or delete an off-chain account at any time. You may delete it while signed in, or ask us to delete the off-chain record as in Section 35. We cannot delete public blockchain history. If you lose the email, the password, or the wallet that can sign, we may be unable to restore the account.
• Account login is provided AS IS. It can fail, expire, or be unavailable. A login is not a promise that any game score, swap, or other feature is tied to the account.

DO NOT SIGN A LOGIN MESSAGE YOU DID NOT READ. DO NOT ENTER A SEED PHRASE ANYWHERE ON THIS SITE. A LOGIN IS NOT A TRANSACTION.

7. THIRD-PARTY PROTOCOLS, BRIDGES, RPCS, AGGREGATORS

The Platform may integrate or reference third-party software and networks, including (without limitation) Solana, Ethereum and other EVM chains, Jupiter, Kyber, or other aggregators, DexScreener or similar market lists, Trix Market or similar token lists, RPC providers (e.g., public RPCs, Helius, or others), IPFS/metadata hosts, wallet browser extensions, mobile wallets, CDNs, AI model providers, hosting providers (e.g., Netlify), and analytics or infrastructure vendors.

Those third parties are independent. We do not control them and disclaim all responsibility for their availability, security, correctness, fees, front-ends, terms, or privacy practices.

Your use of third-party services is governed by their terms. Review them separately. We are not liable for losses arising from third-party downtime, bugs, hacks, insolvency, or policy changes.

8. SWAPS, QUOTES, SLIPPAGE, MEV, FAILED TRANSACTIONS

• Displayed quotes are estimates only and may differ from executed results.
• Slippage, price impact, routing changes, partial fills, failed transactions, stuck transactions, and fee burns can and do occur.
• MEV, sandwiching, and adversarial ordering may affect outcomes on public mempools.
• A “success” UI state does not guarantee economic success or finality; always verify on a block explorer.
• We are not responsible for incorrect token selection, scam tokens, lookalike tickers, or user error.
• Access controls: Different swap surfaces on the Platform may have different eligibility rules. As of the current product: (a) the general Jupiter swap path is intended for any compatible Solana wallet the user controls; (b) “old rewards-pool rails” / Pond Scum dossier swap tooling is limited to wallets that appear on an activated Pond0x mining-rig list maintained by the Platform (sourced from third-party analytics such as Dune and/or operator allow/block lists), and may enforce session/auto limits. Eligibility data may be delayed, incomplete, or empty (in which case old-rails access may fail closed). We may change, tighten, loosen, or remove such gates at any time. Access denial does not entitle you to damages. Operational detail for users is published at /docs/community-swap-rules.html and may lag or lead the live UI; live behavior and these Terms control.
• Appearing on an activated-rig list or allowlist does not guarantee that any third party (including Pond0x or Dune) will index your swap, credit boost/rewards, or maintain any rail. Third-party data feeds and APIs are provided AS-IS.
• Quantum is a separate surface from regular Jupiter and from old rewards-pool rails. Its rules are Section 8A. It is not an activated-rig product and it is not the 0% Jupiter swap page.

8A. QUANTUM DESK — TEN RISK LEVELS; OWN RISK

Quantum is optional experimental software. It is not financial, investment, tax, legal, or trading advice. It is not a broker, exchange, adviser, fund, signal service, or fiduciary. You can lose some or all of the assets you use with it, including the entire balance of the wallet you connect. You use it at your own risk.

• The desk is at /quantum/past (the same page is also served at /quantum/present). You log your own wallet in. DOSWAPZ does not hold your keys, does not custody your funds, and does not sign for you. Login is only so the desk can send transactions to your wallet. After that login, Quantum chooses when to buy and when to sell. Each transaction still has to be signed by your wallet.
• The page never asks for a seed phrase or a private key. Any prompt that does is not this desk. Treat it as hostile and stop.
• Paper mode simulates a book in your browser. It does not move coins. A paper fill is not a real trade and is not evidence that a live swap would have filled at that price.
• After wallet login, live mode builds an unsigned swap and opens Phantom (Solana, via Jupiter) or MetaMask (Ethereum, via Kyber) so you can approve or reject it. Quantum chooses the buy or the sell. You are the signer. A rejected prompt sends nothing. An approved prompt can spend the assets in that wallet, pay network fees, and still fail, revert, or fill at a worse price.
• DOSWAPZ fee on Quantum is zero. No part of a Quantum swap is routed to doswapz.com, a DOSWAPZ treasury, or any site fee wallet. The SOL meter is the amount that goes into the swap. The lowest setting is 0.01 SOL. The most one buy can put in is 1 SOL. Network gas and priority fees sit on top of that amount and are paid to the network, not to DOSWAPZ. A third-party router can still charge its own fee. That fee is not ours. The signed Solana swap is a single Jupiter route back to your wallet, with no platform-fee account attached. That is meant to keep the wallet prompt to a normal swap. It does not guarantee that Phantom, Blowfish, or any other wallet scanner will stay silent, especially on a new or hostile token. Mints that Rugcheck marks as rugged or honeypot-like are refused before a popup opens.
• There are ten risk levels. Level 01 watches. Level 02 is small. Level 03 is named Super Degen Crazy Aggressive and chases fast names. Levels 04 through 10 are looser than Level 03. Level 10 is the loosest filter on the page. None of the levels is safe. Every level can go to zero. A higher number is not a recommendation.
• Scores, “hot” lists, liquidity, volume, and five-minute moves come from third parties, including DexScreener, without independent verification. They can be wrong, late, washed, or manipulated. A name on the tape is not a buy rating and not a safety check.
• Tokens can be scams, rugs, honeypots, or impossible to sell. Lookalike tickers are common. Quotes are estimates. Slippage, price impact, router failure, MEV, and failed transactions can cost money even when the wallet shows a success path.
• Before a live buy the page asks you to confirm that you are at least 18 (or the age of majority where you live, if higher) and that you accept total loss. Those checkboxes are your acknowledgment. They do not make the desk suitable for you. If you do not agree, do not connect a wallet and do not arm live buys.
• You are solely responsible for legality where you live, including securities, commodities, gambling, and sanctions rules. Sanctioned persons and prohibited jurisdictions may not use Quantum. Void where prohibited.
• DOSWAPZ is not a party to your swap, not your counterparty, and not responsible for Jupiter, Kyber, Phantom, MetaMask, DexScreener, RPCs, or the tokens you touch. Those services have their own terms.
• No uptime, fill, profit, or exit is promised. The desk can break, rate-limit, show an empty tape, or be removed without notice. Limitation of liability, AS-IS terms, assumption of risk, and indemnification in this document apply in full.
• Quantum is a swing book. It tries to sell the whole position when it sees a downtrend, to take a small profit, to sell a green trade before that gain is gone, and to cut a loser quickly. New tokens are flattened sooner than older names. A name that stays red is sold. A falling tape, heavy selling, or a liquidity drop is treated as a downtrend. That tactic is not a promise of a win rate, a profit, or a fill. A mint that fails the honeypot check, has no sell route, would not return most of the stake on a round trip, or is flagged for a hostile tax, freeze, mint authority, transfer hook, pause, or rug is not bought. A mint that just sold for a large loss is not bought again that day. Live arm holds one position at a time. Closed trades can change later entry weights. They do not make a later trade safe.

Never arm Quantum with a wallet whose loss would hurt you. Prefer a separate wallet that holds only what you can lose entirely. If you do not understand a level, do not use it.

9. TOKEN LAUNCHERS, MEMECOINS, LISTINGS, “MARKETS”

Tools that assist with creating, launching, listing, viewing, or discussing tokens do not make us an issuer, underwriter, promoter (in the regulated sense), or partner of any token - including tokens named after or thematically related to DOSWAPZ - unless a separate written instrument expressly says otherwise, signed by an authorized party.

• Anyone can deploy tokens with arbitrary names, images, and supply parameters. Metadata can lie.
• “Featured,” “new,” “hot,” “vantablack market,” or similar UI labels are organizational/UX devices, not investment grades.
• Memecoins and microcap tokens frequently go to zero. Assume that outcome is likely.
• No token on or related to the Platform is guaranteed utility, revenue share, governance rights, or redemption value.
• You are solely responsible for securities, commodities, money transmission, and consumer-protection compliance if you create or distribute tokens.
• Launch fees, creator allocations, and any site-fee split shown in Vantablack / Trix-style launchers are interface parameters only. They do not make DOSWAPZ a party to the token, a promoter, or a guarantor of any curve, graduation, or market.
• Any launch fee paid to a published site wallet is a voluntary software-use charge, not an investment, not equity, and not refundable once broadcast on-chain.

10. MARKETS, TICKERS, STATS, “LIVE” DATA

Prices, volumes, swap counters, dossiers, pond stats, scoreboards, Quantum scores, and tickers may be delayed, cached, incomplete, rate-limited, estimated, empty, or wrong. Data may come from third parties (including Pond0x, Dune, Cary-style community endpoints, Jupiter, Kyber, Trix, DexScreener, and public RPCs) without independent verification. A blank, partial, or stale Pond dossier is not a Platform breach and creates no duty to repair, refund, or credit any third-party reward.

Do not make financial decisions based solely on Platform displays.

11. GAMES, SIMULATIONS, SCOREBOARDS, ENTERTAINMENT

• Games (including Crypto Dad, Crypto Mom, arcade titles, TBB, maze experiences, and similar) are for entertainment and artistic expression and may include flashing or glitch visuals described in Section 16A.
• In-game currency, “scores,” “heat,” “family,” “runs,” or narrative outcomes have no cash value unless a separate, explicit, real-money program is clearly disclosed in writing. The only such program contemplated on the Platform is optional Awardz Pool (Section 11A and /docs/awardz-pool-rules.html). Awardz entries, when you opt in on the live page, are contest consideration you may lose entirely.
• Simulations are not financial models you should rely on for trading.
• Leaderboards may use wallet signatures or X sessions for soft verification; those prove control of a key or social login at a moment in time, not identity, not skill fairness guarantees, and not immunity from bots or exploits.
• We may reset scores, ban cheaters, void contest entries, or alter game rules at any time.

Where gambling, lottery, or paid-contest laws could apply to any feature, you must not use that feature if prohibited where you are. You are solely responsible for compliance with local gambling, loot-box, and skill-game laws.

11A. AWARDZ POOL — VOLUNTARY PVP SKILL CONTEST; OWN RISK; VOID WHERE PROHIBITED

THIS SECTION IS THE WRITTEN DISCLOSURE OF AN OPTIONAL REAL-MONEY PROGRAM. IF YOU DO NOT OPT IN, NOTHING IN THIS SECTION REQUIRES YOU TO SEND FUNDS. ARCADE PLAY REMAINS FREE.

A. Nature — player versus player

Awardz Pool, if and when armed on the live Site, is a voluntary player-versus-player (PVP) arcade skill contest among users who choose to enter. Entrants compete against each other for the highest eligible score at the end of a stated lock (day, week, or month, UTC). The prize pool is other players’ voluntary entries (and the winner’s own entry). DOSWAPZ is the contest operator / administrator. DOSWAPZ is not your opponent, not a house bank betting against you, not a bookmaker taking the other side, and not a casino offering a house game.

Operational player rules live at /docs/awardz-pool-rules.html and on the Awardz UI. Those rules are incorporated here. If they conflict with this document, this document controls.

B. Own risk; total loss; no dollar guarantee

• A confirmed Awardz send is contest consideration for a PVP skill contest, not a bank deposit, not a payment account, not escrow of your general funds, and not a custodial wallet product.
• On-chain transfers are irreversible. Wrong network, amount, or address is your loss.
• Displayed USD is an accounting / pooling unit so mixed SOL and ETH can share one book. Settlement pays from crypto actually held for that lock. If inventory is worth less than the USD book at the settlement oracle, the lock pays 100% of holdings and nobody is owed a top-up from operating funds.
• If inventory covers the USD book, leftover coins may remain with DOSWAPZ as conversion difference / administrative consideration for running the contest — not a line-item user “fee,” not an investment return to you, and not guaranteed house profit.

C. Void where prohibited; not an offer where unlawful

Awardz is void where prohibited and is not offered to any person for whom entry would be unlawful. You must not enter if your jurisdiction treats this as gambling, an unlicensed lottery, an unlicensed contest, money transmission, or any licensed activity we do not hold. You are solely responsible for determining legality where you are. We may geo-restrict, freeze, void, or refuse entries without notice and without damages.

We operate Awardz as a skill contest among players. A regulator may disagree. If they would call it gambling or require a license we do not have, you must not enter. These Terms do not make Awardz lawful in every place.

D. Eligibility; opt-in acknowledgments

• 18+ or age of majority, whichever is higher; full contract capacity; not a sanctioned person (Section 2).
• Live entry requires the on-page acknowledgments (voluntary; PVP; own risk; USD estimate; burner / OPSEC; auto-disconnect; legal reading) plus a matched intent and confirmed native SOL or ETH transfer to the published address shown at send time.
• Unmatched or unsolicited transfers need not be treated as Awardz entries and need not be returned.
• Wallet auto-disconnect after a confirmed send is a safety practice, not a warranty against malware, phishing, or user error.

E. Integrity; no fairness warranty

Scores may be client-posted, delayed, spoofed, or botted. We may void entries, freeze a lock, refuse or delay payout, retally, cap, or ban at sole discretion for integrity, legal, security, or operational reasons. A visible leader is not a vested prize. There is no warranty of detection, skill purity, uptime, or timely auto-pay. Auto-pay may remain off.

F. Payout address; taxes

If a payout is made, it is to the same address that entered, in the asset(s) the lock still holds, without a guaranteed USD value. You are solely responsible for taxes on entries, winnings, conversions, and abandoned value (Section 27).

G. What Awardz is not

• Not an investment, security, commodity interest, profit share, or interest-bearing account.
• Not a guarantee, insurance policy, or swap of a dollar obligation.
• Not legal, tax, or financial advice.
• Not required to play DOSWAPZ arcade games.

11B. FANTASY FOOTBALL — FREE DEMO AND PLANNING DESK; NOT AN OFFERING; PAID CONTESTS OFF

THIS SECTION COVERS THE FANTASY FOOTBALL MODULE. IT IS NOT AWARDZ POOL. IT IS NOT A LIVE PAID FANTASY CONTEST. IT IS NOT AN OFFER TO SELL SECURITIES OR OWNERSHIP.

• The module is a free entertainment demo plus a public recap of planning documents. Simulated scores and sample leaderboards have no cash value.
• Paid contest amounts displayed as “LICENSE PENDING” do not collect funds and are not an invitation to play for money.
• Language about founding ownership, staged capital, or “own part of it” is a planning concept. It is not a subscription, token sale, profit share, or investment contract offered on the Platform.
• Do not send money, crypto, or goods because of this module unless and until a separate, counsel-reviewed offering or licensed contest is expressly opened in writing.
• Player contest funds (if ever lawfully collected) must be segregated from company/founding capital and from $DOSWAPZ, Trix, Awardz, or other treasuries.
• Citations to Arizona Department of Gaming or industry market size are not a license, not a forecast, and not a representation that DOSWAPZ is authorized to operate paid fantasy contests.
• 18+. Void where a paid contest or securities solicitation would be unlawful. You are responsible for local law.

12. NFTS, MINTS, GENERATIVE / MATH ART

• Mint interfaces may produce or reference on-chain or off-chain art/metadata. Ownership of a token does not automatically transfer copyright in underlying artwork unless expressly stated.
• Minting can fail; gas/fees can be lost; metadata can break if hosts change.
• “Gallery,” “edition,” or sample images may be previews and not guarantees of rarity, demand, or secondary-market value.

13. AI FEATURES (INCLUDING HARBINGER)

AI chat and generative features may be unavailable, rate-limited, satirical, inaccurate, offensive, or hallucinated. Outputs are not advice, not facts you should rely on, and not statements of the Platform as a legal entity unless separately verified.

• Do not share secrets, seed phrases, private keys, passwords, or sensitive personal data with AI interfaces.
• AI providers may process prompts under their terms; availability depends on API keys, credits, and third-party uptime.
• We disclaim liability for actions you take based on AI output.

14. USER CONTENT; ATTIC; COMMUNITY SPACES

If you upload, post, or transmit content (images, text, links, signatures, metadata):

• You represent you own it or have all rights/licenses needed, and that it does not infringe IP, privacy, publicity, or other rights.

• It is not a credit score, not financial or “who to follow” advice, not an investment, and not a license to resell other people’s identities.
• USD SKU prices convert to BTC, ETH, or SOL at spot (plus displayed slippage). API-cost / Layer-cut split on screen is an estimate, not a fiduciary accounting to you.

B. Payment; irreversible; published treasuries

CIRCLE on first load is demo data so you can use the board without paying. A live person list requires a batch/nightly rollup and third-party X API access. Official liking-users is not called on page load. There is no uptime SLA, no warranty that any named person will appear, and no warranty of completeness. Until the live job is connected, RUN REPORT may still show the demo rollup.

D. Eligibility; prohibited use

• 18+ or age of majority, whichever is higher (Section 2).
• You must not use the feature to scrape, dox, harass, or commercially redistribute other people’s personal data in violation of law, X’s terms, or Sections 14, 17, and 20.

PAYPAL PAYS THE SELLER. CRYPTO PAYS A PUBLISHED OPERATOR WALLET FOR THAT SALE ONLY. THE FULL PRINCIPAL IS RELEASED OR REFUNDED UNDER THE WRITTEN RULE. DOSWAPZ DOES NOT TAKE A FEE FROM THAT PRINCIPAL, DOES NOT INSURE THE SALE, AND DOES NOT SHIP THE ITEM.

E.K. is published. These terms apply as soon as you use the page. Paths: /ek, /ek/past, and /ek/present. The classic hub map has an E.K. box. The orbit hub does not. Section 15 merch, if DOSWAPZ ever sells its own goods, is a different thing. An E.K. listing is a sale between the listing account and the buyer.

A. Zero fee; the principal is paid in full

• The DOSWAPZ fee is zero. There is no listing fee, no insertion fee, no final-value fee, no commission, and no percentage cut of the item price or of the shipping price.
• The sale principal is not a DOSWAPZ fee. On crypto, the buyer pays the item price plus shipping into the escrow wallet. On release, the seller receives that full principal in the same asset. On refund, the buyer receives that full principal back. DOSWAPZ does not haircut it, convert it, or stake it. Staking would put the principal at risk, so it is not done.
• DOSWAPZ may keep yield, or any balance left in the escrow wallet after the exact principal has been sent. That leftover is not a fee on the sale. The escrow wallet pays the network fee on the way out, so the recipient gets the full principal.
• A chain network fee (gas), if the network charges one, is paid to the network. It is not a DOSWAPZ fee.
• If PayPal charges the seller, that charge is PayPal’s. It is not a DOSWAPZ fee. DOSWAPZ does not add a fee on top of PayPal. PayPal is not put in escrow.

B. Who can sell; how the buyer pays

• Anyone may browse. Only a DOSWAPZ account login (Section 6A, cookie dz_acct) may list an item. You must be at least 18, or the age of majority where you live if higher (Section 2).
• The seller chooses one rail: SOL, USDC on Solana, ETH, USDC on Ethereum, or the seller’s PayPal email. Bitcoin is not a checkout rail.
• A wallet login locks the seller’s payout address to the public wallet already on that account for that chain. An email login must enter the payout address or PayPal email twice. The seller’s payout address cannot be the escrow address.
• PayPal pays the seller’s PayPal email. DOSWAPZ does not hold the PayPal balance. A PayPal dispute stays inside PayPal. DOSWAPZ does not decide it and does not refund it.
• Crypto pays the published escrow wallet for that chain. USDC uses the same address as the chain it rides. The buyer must be logged in. The page tells the buyer when the funds are locked and that the seller has not been paid. A crypto sale already marked sold before this rule stays a payment to the seller. A new crypto checkout uses escrow.
• The published wallets, unless the operator rotates them on the server, are SOL (and USDC on Solana) 3btL8c8HaFXqRqzA6TwsYK4Bq5aANP2KtpxiH4v9tgqt, ETH (and USDC on Ethereum) 0x15e85a85B7026875d3529EF0c6de2723C285DA11, and BTC bc1qnm46ngy8nf5vfwsengrrjsuwpvknd8xm8mn7pq. The BTC address is published only. There is no Bitcoin pay button. The live checkout address is the one the E.K. page shows for that chain.
• This is a limited hold of one sale’s principal in a published operator wallet. It is not a bank, not a deposit account, not general money transmission, not custody of the user’s seed, and not custody of any other funds. The site never asks for a seed phrase, a private key, or the escrow key, and it does not store them. Release and refund are transactions the escrow wallet signs. The API only checks that the chain shows the exact principal went to the address the rule names.
• The lock is that written rule plus that chain check. It is not a smart contract. The operator holds the escrow key. If the operator does not send the authorized transaction, the page cannot force it. DOSWAPZ is not an insurer and there is no buyer-protection fund. If the buyer and the seller disagree, the full principal stays frozen. DOSWAPZ does not pay both of them and does not pick a winner.
• DOSWAPZ is not a broker, exchange, or guarantor of any E.K. sale. PayPal, the chains, the wallets, and the carrier are independent (Section 7).
• The page may hold a listing for a short checkout window so two buyers are less likely to pay at once. Crypto holds are about fifteen minutes. PayPal holds are about twenty minutes. That checkout window is not the escrow. A payment that lands after a listing is pulled can still be a payment the chain will not undo. Check the listing before you pay.
• PayPal checkout on the page is armed only when the operator has connected PayPal. Until then, the page can show the seller’s PayPal email and the total so the buyer can pay the seller directly. An unarmed PayPal button does not mark the item sold.

B2. When crypto moves

• No shipping proof within 3 days of the lock: the full principal is authorized back to the buyer.
• After proof, the buyer marks the item received: the full principal is authorized to the seller.
• After proof, the buyer stays silent for 3 days and does not open a dispute: the full principal is authorized to the seller. That stops a buyer from ghosting the sale.
• The buyer may open a dispute for not received, not as described, or damaged. An open dispute freezes 100% of the principal. It does not auto-release. It moves only when both sides accept the same outcome: the seller accepts a full refund, or the buyer drops the dispute. There is no partial split.
• Pickup and digital still need a handoff note. That note is the proof for those listings.
• The item is not marked sold on crypto until the release transaction is checked. A checked refund is marked refunded. PayPal still marks the item sold when PayPal completes.

C. Shipping, pickup, and digital

• The seller chooses ship, pickup, or digital.
• If it ships, the seller sets a flat shipping price in the same coin or dollars as the item, and a ship-from place. Zero means the seller ships free. The buyer pays the item price plus that shipping price. On crypto, both sit in escrow and both are part of the principal. On PayPal, the seller receives both, subject to PayPal.
• Before checkout of a shipped listing, the buyer enters a ship-to name, street, city, region, postal code, and country. That address is not shown on the public board. It is stored for the order and shown to the selling account only after crypto is locked in escrow or a PayPal payment is marked sold. The seller then posts one proof: a carrier (USPS, UPS, FedEx, DHL, or Other) and a tracking number. Tracking is public on that listing after the seller posts it. A posted proof is not replaced.
• Pickup and digital listings do not take a ship-to address. The seller marks those handed off with a note.
• DOSWAPZ does not pick, pack, ship, insure, or buy postage. DOSWAPZ does not guarantee delivery, timing, customs, duties, condition, title, authenticity, or that the item matches the listing. The seller and the buyer own that deal, including loss in transit.

D. What you may list

• List only what is yours to sell. You represent that you have the right to sell it and that the title, photo, and description are not false.
• You must not list stolen goods, weapons, ammunition, illegal drugs, child sexual material, counterfeit goods, or another person’s login, seed phrase, or private key.
• The page may refuse some of those words. That filter is not a complete review. You remain responsible. We may remove a listing without notice (Sections 14 and 17).
• You may post up to twelve photos of the item. The first photo is the cover on the board. The rest show when someone opens the listing. Photos are optional. There is no photo fee. DOSWAPZ fee on the sale stays zero. Photos and text you upload are user content under Section 14.
• Department pictures on the shop are samples. They are marked not for use. They are not listings, they are not for sale, and they cannot be used as a listing photo.

E. Bids, offers, categories, feedback, rules, and violations

• The seller picks a department and a type inside it, a condition (new, like new, used, or for parts), and either buy now or bids. Buy now can also take offers. A bid listing takes bids that start at the typed price and must go up. The seller sets the bid clock to 1, 3, 7, or 10 days. When that clock ends, new bids are refused. The seller may still accept a bid that was already placed. Ending the clock does not move money, charge a fee, or mark the item sold. The DOSWAPZ fee stays zero.
• A bid is not a payment. An offer is not a payment. DOSWAPZ does not charge a bid fee, an offer fee, or a feedback fee. The DOSWAPZ fee stays zero.
• If the seller accepts a bid or an offer, the listing price becomes that amount. Shipping, if any, is still added. The buyer then pays that total on the same rail: into escrow on crypto, or to the seller on PayPal. Until that payment is verified, the item is not sold. Accepting during a checkout hold is refused.
• DOSWAPZ does not guarantee that a bidder or an offer-maker will pay. A bid or an offer can be declined. Identity of a bidder or an offer-maker is not published. The seller sees the amount and the note.
• After a PayPal sale, or after a crypto escrow is settled, the buyer account that was logged in at payment and the seller account may each leave one feedback note: up, middle, or down, plus a short comment. Buyer feedback about the seller is counted on later listings from that seller. Feedback is public. The account id is not. Crypto feedback waits until the release or refund transaction is checked.
• Rules: list only what you have the right to sell. Do not list stolen goods, weapons, ammunition, illegal drugs, counterfeit goods, or another person’s login, seed phrase, or private key. Do not use a bid, an offer, feedback, or a report to harass or to post those prohibited items.
• A logged-in user who is not the seller may report one violation per listing. The reasons are prohibited item, stolen, counterfeit, scam, not as described, and harassment. The report is stored with the listing and is not shown on the public board. A report does not by itself cancel the listing, pull the payment, or decide a dispute. DOSWAPZ may still remove a listing (Sections 14 and 17).

F. Risk

Goods can be misdescribed, never sent, damaged, or unlawful where you live. Crypto sent to the wrong address cannot be pulled back by the page. The escrow key is held by the operator, so a release or a refund happens only when that wallet sends it and the chain check passes. If the buyer and the seller disagree, the full principal stays frozen and neither of them is paid until they accept the same outcome. There is no insurance. PayPal can reverse or freeze a payment under PayPal’s own rules. You are solely responsible for taxes, duties, and the consumer-law duties on your sale or purchase (Section 27). Do not use E.K. where a private sale of this kind is unlawful. Limitation of liability, AS-IS terms, assumption of risk, and indemnification in this document apply in full.

DOSWAPZ FEE IS ZERO. PAYPAL PAYS THE SELLER. CRYPTO PAYS ESCROW. THE FULL PRINCIPAL IS RELEASED OR REFUNDED. A DISPUTE FREEZES THE FULL AMOUNT. DOSWAPZ DOES NOT PICK A WINNER.

15C. ETHSCRIPTIONS — USER NFT MARKET; OPEN TO EVERYONE; E.K. ETH ESCROW

ETHSCRIPTIONS IS A MARKET OPEN TO EVERYONE FOR ETHSCRIPTIONS ON ETHEREUM. DOSWAPZ IS NOT THE SELLER, NOT THE BUYER, AND NOT A PARTY TO THE SALE. ETH IS PAID TO THE SAME PUBLISHED ETH ESCROW ADDRESS USED BY E.K. A MINT KEEPS A 0.5% SITE FEE IN THAT ESCROW. THE TRIXMOJI PHUNKS MINT IS OFFLINE AND IS NOT OFFERED. THE MARKET STAYS OPEN. A RESALE PRICE INCLUDES 2.5% FOR THE CREATOR. THE BUYER PAYS THAT PRICE. THE SELLER RECEIVES 97.5%. DOSWAPZ RECEIVES 0 ON THAT RESALE. IF THE CREATOR CHOSE 5%, THE BUYER PAYS THE ASK PLUS 5.5%, THE SELLER RECEIVES THE ASK, AND DOSWAPZ RECEIVES 0.5%. A REFUND RETURNS THE FULL AMOUNT THE BUYER PAID. • Paths: /ethscriptions, /ethscriptions/past, /ethscriptions/present, and /ethscriptions/how. Instructions are at /docs/ethscriptions.html. This is not the E.K. goods shop (Section 15B). It uses the E.K. ETH escrow address only. SOL, BTC, and PayPal are not rails here.
• The market is open to everyone. There is no invite and no private shop. Listing and buying use the DOSWAPZ account login and an Ethereum wallet on that account.
• Launchpad. A creator opens a collection with a name, a symbol, a supply from 1 to 10000, one mint price, a cap of 1 to 20 per wallet, and a resale royalty of 2.5% or an optional 5%. The creator inscribes each piece and locks it to escrow. A mint is a primary sale of one locked piece at that mint price. The site fee on that mint is 0.5% and the creator receives 99.5%. Closing a collection stops new deposits. Pieces already in escrow can still be minted until they sell, or until the creator pulls an unpaid piece. A later resale of a collection piece uses the royalty the creator chose at launch. The page does not inscribe the piece and does not hold the escrow key.
• Random mint. The buyer does not choose the piece. The page shows a blank cover and does not show the picture, the token number, or the ethscription id before delivery. When the escrow wallet sends the piece to the buyer’s wallet, the page reveals that picture. A public Ethereum transaction can still be read by anyone who already has its hash.
• TRIXMOJI PHUNKS. This mint is offline. The page does not list it and does not take a new mint payment. The rest of this market stays open. Other listings still require the account login. Other collections still use a blank cover until delivery.
• Views. The market page has Collections, Market, My collection, Activity, and Create. My collection shows the logged-in account’s launched collections, pieces already in that wallet, pieces paid for and not yet delivered, and pieces that account has listed. A piece that is not yet in the buyer’s wallet stays on the blank cover in My collection too.
• What you have to do. The instructions are on the market page and at /docs/ethscriptions.html. The plain copy is docs/ethscriptions-readme.md. You do every step yourself.
  • Log in and add the Ethereum wallet to the DOSWAPZ account. The lock transaction has to come from that wallet.
  • Create each ethscription in that wallet. The transaction data starts with data:. The ethscription id is that transaction hash. The page does not send this transaction.
  • Open a collection: name 1 to 32 characters, symbol 1 to 10 letters or numbers, supply 1 to 10000, mint price 0.0002 to 100 ETH, max per wallet 1 to 20, and a resale royalty of 2.5% or 5%.
  • Send each piece to the published ETH escrow with 0 ETH. The hex data is only that ethscription id.
  • Deposit the confirmed lock on the collection. Repeat until you stop. Closing deposits stops new pieces. Pieces already locked can still be minted.
  • A buyer pays the mint price to escrow with empty hex data. The buyer receives the piece only when the escrow wallet sends it. The page checks that send. It does not sign it.
  • A later seller lists a resale price. That price includes 2.5% for the creator. The buyer pays the price. The seller receives 97.5%. DOSWAPZ receives 0. If the creator chose 5%, the buyer pays the ask plus 5.5% and the seller receives the ask.
• Primary sale. The first sale on this board by the address that created the ethscription. The buyer pays the mint price. Site fee 0.5%. The seller receives 99.5%. There is no separate creator royalty on that mint.
• Secondary sale. A later sale, or a first listing here by someone who is not the creator. The price includes 2.5% for the creator. The buyer pays that price and nothing more. The creator receives 2.5%. The seller receives 97.5%. The DOSWAPZ fee on that resale is 0%.
• Creator choice of 5%. Only the creator can choose this, at launch or on the creator’s own first listing. A later seller cannot change it. The seller still receives the asked amount. The buyer pays the ask plus 5.5%. The creator receives 5%. DOSWAPZ receives 0.5%, which stays in the escrow. A seller who is not the creator cannot select this.
• Wei is split in integers from the price. On a 2.5% resale the buyer pays the price, 2.5% of that price is the creator share, and the seller receives the rest. DOSWAPZ receives 0. On a creator choice of 5%, the seller payment is the exact ask and the creator 5% plus the 0.5% site fee are added to what the buyer pays. The site share is not sent to a second wallet. It remains in the E.K. escrow. When the seller is also the creator, the seller payment includes the creator royalty.
• An ethscription id is the Ethereum transaction that created it. A transfer is a 0 ETH transaction whose hex data is that id, sent to the new owner. A buy payment is an ETH transaction to the escrow address with empty hex data for the exact amount the buyer owes.
• The page checks those transactions. It does not ask for a seed phrase, a private key, or the escrow key, and it does not store them. Release and refund are transactions the escrow wallet signs. If that wallet does not send them, the page cannot force it. A resale release to a different creator is a separate empty-calldata payment of the royalty. A refund sends the ethscription back to the seller and the full amount the buyer paid back to the buyer. The site fee is not kept on a refund.
• The public ethscription index can be down. A lock is checked as an Ethereum transaction into escrow from the seller’s logged-in wallet. That check does not insure that no later protocol rule ignores the transfer. You can lose the ETH and the ethscription. There is no insurance.
• DOSWAPZ is not a broker, exchange, or guarantor of any sale. Ethereum, the wallet, and any indexer are independent (Section 7). Do not list an ethscription you do not have the right to sell.

16. EXPERIMENTAL / BETA / GLITCH SOFTWARE

The Platform is experimental software provided for creative and educational exploration. Features may break, glitch, brown out, display incorrect data, or disappear without notice.

No uptime SLA is offered. Maintenance, deploys, and partial outages are expected.

Intentional visual artifacts (scanlines, chromatic aberration, tear, Time Machine travel overlays, CRT bloom, strobe, and “Glitch Protocol” effects) are part of the artwork. They are not defects you may sue over, and they do not constitute a failure of the Platform.

16A. PHOTOSENSITIVITY; SEIZURE; FLASHING / GLITCH VISUALS

The Site, including without limitation the Time Machine, era travel between Past / Present / Future, hub transitions, Pond Scum, arcade titles, Media Lab, Harbinger, and other pages, may display rapid flashes, full-screen white/black cuts, color-channel splits, rolling tear bars, and high-contrast CRT simulation.

• These effects are intentional, artistic, and experimental. They are not medical devices, not accessibility-certified, and not guaranteed to meet any photosensitivity or WCAG flashing-threshold standard.
• If you or anyone in your household has a history of epilepsy, photosensitivity, migraine with aura, vestibular disorders, or similar conditions, you must not use Time Machine travel, must reduce or disable glitch settings where offered, and should leave the Site if effects persist.
• Stop use immediately if you experience dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, any involuntary movement, or convulsion. Seek medical help if needed.
• Parents and guardians are solely responsible for preventing minors (already barred by Section 2) and photosensitive viewers from accessing these effects.
• Browser “reduce motion” preferences, if honored by some pages, are a courtesy only and are not a safety guarantee. Time Machine travel is designed to glitch and may ignore reduced-motion preferences.

YOU ASSUME THIS RISK SOLELY BY CONTINUING TO USE THE SITE.

17. PROHIBITED CONDUCT & SANCTIONS

You agree not to:

• violate any law, regulation, or third-party right;
• use the Platform for fraud, money laundering, terrorist financing, sanctions evasion, or market manipulation;
• attempt unauthorized access, scrape abusively, DDoS, inject malware, or reverse engineer in violation of law;
• interfere with others’ use, or exploit bugs for unfair advantage without responsible disclosure;
• misrepresent affiliation with DOSWAPZ to commit fraud;
• use automated systems to spam, drain, or harass;
• list stolen goods, weapons, ammunition, illegal drugs, child sexual material, counterfeit goods, or another person’s login, seed phrase, or private key on E.K. (Section 15B).

We may cooperate with law enforcement and service providers when we believe disclosure is legally required or reasonably necessary to protect users, the Platform, or the public.

18. INTELLECTUAL PROPERTY

The Platform’s original branding, layout, text, code (to the extent owned by us), visual design, and creative works are protected by applicable IP laws. Third-party marks (wallets, chains, protocols, KOLs portrayed in parody/art contexts, etc.) remain their owners’ property and are used for descriptive, artistic, or interoperability purposes only - no affiliation or endorsement is implied unless expressly stated.

Except for limited rights to use the public Site as offered, no license is granted to copy, frame, mirror, resell, or commercially exploit the Platform without prior written permission.

Parody, satire, and transformative artistic expression may appear; such content is not a statement of fact about real persons or entities.

19. DMCA / IP COMPLAINTS

If you believe content on the Platform infringes your copyright, send a notice with: (a) your contact info; (b) identification of the work; (c) URL/location of the allegedly infringing material; (d) a good-faith statement; (e) a statement under penalty of perjury that you are authorized; and (f) your physical or electronic signature - consistent with 17 U.S.C. §512 where applicable.

Notices and counter-notices may be sent via the contact method listed in Section 35. We may remove content and terminate repeat infringers where appropriate.

Trademark complaints should include comparable detail and a description of the mark and confusion alleged.

20. PRIVACY; LOCAL STORAGE; TELEMETRY

• The Site may store preferences locally (e.g., glitch level, intro skips, last destination) in your browser storage.
• Server logs, CDN logs, rate-limit records, and security telemetry may automatically collect IP addresses, user-agent strings, timestamps, and request paths.
• Wallet addresses you choose to connect or publish (e.g., on scoreboards) are public blockchain identifiers and should be treated as public.
• If you use Sign in with X, we request identity only (X user id and @username) to attribute scores you choose to post. We do not request, store, or call endpoints for your posts, follows, likes, lists, bookmarks, or DMs, and we do not keep the X access token after login. Sign in with X is a separate door from Account Login (Section 6A).
• If you use optional Account Login (Section 6A), we store an off-chain record: a random account id, the login method, the time you accepted these Terms and attested that you are 18 or older, a lowercase email if you chose email, a slow password hash (never the password itself) if you chose email, and the public wallet address if you chose a wallet.
• The account session is an HttpOnly cookie named dz_acct. It holds the account id, the login method, and an expiry. It does not hold your email, password, seed, or private key. We never ask for and never store a seed phrase or private key. A wallet login signature is a login proof only and is not a transaction.
• If you buy a shipped E.K. listing (Section 15B), the ship-to name and address you enter are stored with that listing. They are not placed on the public board. They are shown to the selling account only after crypto is locked in escrow or a PayPal payment is marked sold, so the seller can ship the item. The seller may use that address only to fulfill that order. A public listing can show the ship-from place, the shipping price, and, after the seller posts it, the carrier and tracking number. We do not sell the ship-to address. We cannot delete a payment that is already on a public chain.
• The Meme Lab editor runs in your browser. Images you drop or paste are not uploaded to DOSWAPZ servers.
• Do not submit sensitive personal information through experimental forms or AI chat.
• Third-party processors (hosting, RPC, AI) may process data under their policies.
• Because blockchains are public and immutable, transactions you broadcast are permanent and outside our ability to delete.

If applicable privacy laws grant access/deletion rights for off-chain data we control, contact us as in Section 35. That includes an optional account login record (Section 6A). You may also delete that record while signed in. We cannot delete public chain history. We may need to verify requests and may retain data as required for security, legal compliance, or legitimate interests.

Links to X/Twitter, explorers, docs, merch vendors, or other sites are convenience only. We do not endorse and are not responsible for third-party content, security, or policies.

22. AS-IS; DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND ALL CONTENT, TOOLS, APIS, DATA, GAMES, AND INTEGRATIONS ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, FREE OF VIRUSES, OR THAT DEFECTS WILL BE CORRECTED, OR THAT ANY DATA OR QUOTE IS CORRECT.

Some jurisdictions do not allow disclaimer of certain warranties; in those jurisdictions, disclaimers apply to the fullest extent permitted.

23. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DOSWAPZ, ITS OPERATORS, CONTRIBUTORS, AFFILIATES, LICENSORS, HOSTING PROVIDERS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR MULTIPLE DAMAGES; OR ANY PERSONAL INJURY, SEIZURE, MIGRAINE, OR OTHER MEDICAL EVENT; OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, TOKEN VALUE, BUSINESS OPPORTUNITY, OR DIGITAL ASSETS; OR ANY AWARDZ POOL ENTRY, PRIZE, CONVERSION DIFFERENCE, VOIDED SCORE, DELAYED OR FAILED PAYOUT, OR PVP CONTEST OUTCOME; OR COST OF SUBSTITUTE SERVICES; ARISING OUT OF OR RELATED TO THE PLATFORM, ITS VISUAL EFFECTS, TIME-MACHINE TRANSITIONS, OPTIONAL CONTESTS, OR THESE TERMS - WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY, FAILURE TO WARN, STATUTE, OR OTHERWISE - EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) USD $50; OR (B) THE TOTAL AMOUNTS (IF ANY) YOU PAID DIRECTLY TO US (NOT TO BLOCKCHAINS, WALLETS, OR THIRD PARTIES) FOR THE SPECIFIC PAID FEATURE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS PRECEDING THE CLAIM.

The foregoing limitations are fundamental elements of the bargain and apply even if any limited remedy fails of its essential purpose. Liability that cannot be limited by law remains only to the minimum extent required.

24. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless DOSWAPZ and its operators, contributors, affiliates, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your wallets, keys, transactions, tokens, or content; (c) your violation of these Terms or law; (d) your infringement of third-party rights; (e) disputes between you and third parties, including other Awardz Pool players; (f) any token you create, promote, or distribute using Platform tools; (g) any third party viewing the Platform on a device you control, including claims of photosensitivity or seizure; (h) any allegation that DOSWAPZ is an issuer, broker, exchange, adviser, fiduciary, or partner of a token or protocol merely because the Site displayed or routed an interface; (i) your optional Awardz Pool entry, including claims that the contest was gambling, unfair, insolvent, mis-scored, or unlawful where you chose to participate; and (j) your optional use of Quantum, including any risk level, scan, paper book, quote, or wallet-signed swap, and any claim that a level, score, or tape was advice or a promise of profit; and (k) your optional account login (Section 6A), including any claim that an email, password, wallet address, or login signature was a deposit, custody, a funds transfer, insurance, or advice; and (l) your optional use of E.K. (Section 15B), including any listing, photo, sample image, price, shipping charge, ship-to address, carrier, tracking number, pickup, digital handoff, PayPal payment, crypto payment into the published escrow wallet, release, refund, dispute, or yield left in that wallet, and any claim that DOSWAPZ was the seller, the buyer, the shipper, the merchant of record, an insurer, a buyer-protection fund, a fee collector, or the party who picked a dispute winner.

25. ASSUMPTION OF RISK; RELEASE

You knowingly and voluntarily assume all risks described in these Terms and all risks inherent in internet use, experimental software, digital assets, optional PVP skill contests (including total loss of Awardz entries, conversion differences, cheats, voided scores, and failed payouts), optional E.K. sales between users (including misdescribed goods, non-delivery, shipping loss, a crypto principal sitting in a published escrow wallet, a freeze when the buyer and the seller disagree, the operator holding that wallet’s key, irreversible crypto, and PayPal disputes), and flashing / glitch / CRT / Time Machine visuals (including the risk of seizure or other medical event). To the maximum extent permitted by law, you release us from claims arising out of those risks, including claims based on negligence, failure to warn, or product liability (but not gross negligence or willful misconduct where such release is unenforceable).

26. NO FIDUCIARY DUTY; NO PARTNERSHIP

Nothing in these Terms creates a partnership, joint venture, employment, franchise, or fiduciary relationship. You have no authority to bind us. We owe you no fiduciary duties.

27. TAXES; REPORTING; YOUR OBLIGATIONS

You are solely responsible for all taxes, duties, and filings arising from your activities. We do not withhold taxes for you and do not provide tax documents unless legally required and separately stated.

28. FORCE MAJEURE; CHAIN EVENTS

We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, terrorism, labor disputes, utilities failures, government actions, pandemics, internet backbone failures, chain outages, protocol exploits, or third-party service failures.

29. MODIFICATIONS; TERMINATION

We may modify these Terms at any time by posting an updated version on the Site (with a revised “Last updated” date). Continued use after posting constitutes acceptance. We may suspend or terminate access to any feature at any time, with or without cause, with or without notice, without liability.

Provisions that by nature should survive (including disclaimers, limitations, indemnity, and dispute terms) survive termination.

30. GOVERNING LAW; VENUE; DISPUTE PROCESS

To the maximum extent permitted by law, these Terms are governed by the laws of the State of California, United States of America, excluding conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement below where applicable.

Before filing a formal claim, you agree to attempt good-faith informal resolution by sending a written description of the dispute to the contact in Section 35 and waiting thirty (30) days.

Subject to the arbitration section, exclusive venue for permitted court actions shall be the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there - unless mandatory consumer protections in your country of residence require otherwise.

31. ARBITRATION; CLASS ACTION WAIVER

If arbitration is unenforceable in your jurisdiction, the exclusive court venue provisions apply to the extent allowed.

32. SEVERABILITY; WAIVER; ENTIRE AGREEMENT; ASSIGNMENT

• If any provision is held unenforceable, it shall be modified to the minimum extent necessary or severed; remaining provisions continue in full force.
• Failure to enforce any provision is not a waiver.
• These Terms (plus any feature-specific notices expressly presented) are the entire agreement regarding the Platform and supersede prior oral or written understandings on that subject.
• You may not assign these Terms without our consent; we may assign them in connection with a reorganization, hosting change, or asset transfer.
• Headings are for convenience only.
• “Including” means “including without limitation.”

33. CONSUMER NOTICES; CALIFORNIA; EXPORT

California Civil Code §1789.3: If you are a California resident, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

You represent you will not use the Platform in violation of U.S. export control or sanctions laws. Software and technical data may be subject to export restrictions.

Nothing in these Terms excludes non-waivable consumer rights under the laws of your place of residence.

34. FORWARD-LOOKING STATEMENTS

Any statements about future features, timelines, markets, tokens, games, or “roadmaps” are aspirational, uncertain, and subject to change or abandonment without notice. They are not promises, guarantees, or securities offerings.
